IMPLEMENTATION OF TERMS & SALE CONDITIONS

The succeeding terms and conditions will guide the Client's order (as defined below) and the sale by Smart Products Corp via curvtastic.com ® (“curvtastic.com” or “Seller”) of any product available from curvtastic.com (collectively referred to as the “Product”). Some extra terms may accompany the Product and are applicable unless there is a conflict, in which case these Terms and Conditions will dominate.

By purchasing the Product, whether via phone order, on the curvtastic.com website (www.curvtastic.com), in-person, or through other methods, the Client consents to these Terms and Conditions of Sale (known as “Terms and Conditions”) as the governing contract between curvtastic.com and the Client, superseding any other provided terms and conditions by the

Client. Curvtastic.com’s non-objection to provisions contained in any Client communication shall not be seen as a waiver of the Terms and Conditions.

“Client” refers to any individual or entity buying products from curvtastic.com.

These Terms and Conditions of Sale supersede any pre-printed terms on Client's orders, previous written or verbal communications or representations by either party related to the Product or the terms and conditions. They may not be modified by the Client without curvtastic.com’s prior written consent.

ACCOUNTS

Creating an Account. To use specific features of the website (e.g., Services), an account with curvtastic.com (“curvtastic.com Account”) is required, and certain information as requested on the Site registration form needs to be provided. You assure that: (a) all the required registration details you provide are complete, truthful, and accurate; (b) you will maintain such information's accuracy as it changes over time. Your curvtastic.com Account can be deleted at any time for any reason by following the instructions on the Site.

Account Responsibilities. You are accountable for safeguarding the confidentiality of your curvtastic.com Account login information and are wholly responsible for all activities under your curvtastic.com Account. You agree to notify curvtastic.com promptly about any unauthorized use or suspected unauthorized use of your curvtastic.com Account or any other security breach. Curvtastic.com is not liable for any unauthorized use of your curvtastic.com account or loss or damage resulting from your failure to comply with the above requirements.

As a member of curvtastic.com, you consent to receive newsletters and promotional emails including offers from third parties.

BILLING, ORDERS & CREDIT CARD INFO

A valid order must be accompanied by a legitimate payment of the total value of the Product, made via a pre-agreed payment method acceptable to curvtastic.com, whether the order is made online on curvtastic.com’s website (www.curvtastic.com) or by phone.

Curvtastic.com reserves the right to cancel the order at its discretion by reimbursing the sums paid by the Client.

Curvtastic.com will not be held liable to the Client for such cancellations.

We will store your credit card information when you place your first order for use on all future billings. Any automatic billing and/or charges, per the membership rules described upon sign-up, will be automatically applied to your stored credit card unless you notify us beforehand by emailing us at online@smart-products.co. We accept Visa and Mastercard as payment methods. If your payment method reaches its expiration date, and you don't edit your credit card information or cancel your account, you authorize us to continue billing the credit card on file, including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We recommend you to consistently update your payment method information or cancel your account should you wish to end your membership with us.

Purchasers from Canada and the United States will be billed in US dollars.
If you wish to cancel your service, you must inform curvtastic.com at least 5 days prior to your next billing date.

SHIPPING

All shipping costs are incorporated in the subscription price you see on www.curvtastic.com. Orders are prepared and shipped within 1-2 business days following an order placement. Curvtastic.com will ship to any address in Canada or the United States unless it is commercially impractical. Certain remote regions may be excluded from curvtastic.com’s shipping capacity. Curvtastic.com reserves the right to reject or cancel orders where there is no commercially feasible shipping option, and Curvtastic.com won't be liable to the Client for the cancellation of such orders. In such instances, curvtastic.com will refund any amounts already paid by the Client. If an ordered item is damaged during shipping, incorrect, or missing, you must contact curvtastic.com promptly. SECURITY

Curvtastic.com uses a secure system to protect your personal information during transactions. Your credit card information is encrypted the moment a transaction is completed and is inaccessible to curvtastic.com employees. Only the company managing transactions with which curvtastic.com partners receives this encrypted information. Other personal data collected by curvtastic.com is used to dispatch your order, contact you if needed, or inform you of all the opportunities curvtastic.com has available. You may, at any time, request your information be removed from our database.

INDEMNIFICATION

You agree to indemnify, defend, and hold curvtastic.com and its officers, directors, employees, agents, investors, and suppliers (collectively the “Service Providers”) harmless against all losses, expenses, damages, and costs, including reasonable attorneys fees resulting from any violation of these general terms and conditions or any activity related to your account (negligent or wrongful actions included) by you or any other person accessing the website using your Internet account.

THIRD PARTY

Curvtastic.com may link with third-party websites to provide added value to our users. However, despite third party affiliation, curvtastic.com has no control over these linked sites, which have separate private data collection practices unrelated to curvtastic.com. These linked websites are merely for your convenience and are accessed at your own risk.

FORCE MAJEURE

For all purposes of this agreement, force majeure includes any act of God, war, governmental regulation, strike, lockout, drought, flood, total or partial fire, navigation obstruction, loss, damage or detention in transit, defective materials or delays by shippers, or other contingencies or causes beyond Seller's control which might prevent the manufacture, shipment or delivery of Goods. The Seller's obligations may be suspended during force majeure, without the Seller being accountable to the Client for any damages or losses resulting from such suspension.

ARBITRATION, APPLICABLE LAW & JURISDICTION

These Terms and Conditions will be interpreted strictly and exclusively in accordance with the laws of the State of Florida.

NO TRANSFER

Without the express written consent of curvtastic.com, the Client cannot transfer its rights or obligations under this Agreement.

SEVERABILITY

If any provision or provisions of these Terms and Conditions are deemed invalid, illegal, or unenforceable, such provision will be enforced to the maximum extent permitted by law, and the validity, legality, and enforceability of the remaining provisions will not be affected or impaired.

INTELLECTUAL PROPERTY

The Client acknowledges that any invention, patent, industrial design, copyrightable document or object as well as any technical, scientific, marketing or commercial know-how or trade secret related to the Product, including but not limited to any inventions, patents, copyright and industrial design (hereinafter referred to as the “Industrial Property”) is the exclusive property of curvtastic.com.

The Client recognizes and acknowledges that all the trademarks applied on or otherwise used in relation to the Product, whether registered or not (the “Trademarks”), are the exclusive properties of curvtastic.com.

The Client will not take any action which might invalidate any such Trademark or any registration thereof, impair any rights of curvtastic.com or create any rights adverse to those of curvtastic.com. Without limiting the foregoing, the Client shall not, during the course of this Agreement and thereafter, adopt, use, register or seek to register in any class in any country or territory, any trademark which includes or is confusingly similar to any of the Trademarks.
